WAIVER AND RELEASE OF LIABLITY FIELDSTONE HUNTING PRESERVE In consideration of Fieldstone Hunting Preserve, LLC (“Fieldstone”) allowing my use of Fieldstone property, property that has been otherwise procured by Fieldstone, and Fieldstone facilities for hunting, fishing, clay targets, paintball, airsoft, and other outdoor or outdoor related activities, I agree as follows: I fully understand and acknowledge that there are risks and dangers involved in such activities and that my participation in same at Fieldstone and the use of buildings, structures, equipment, automobiles, firearms, weapons, ATV’s, boats, tree stands, roads, bodies of water, and the land in general may result in damage to or loss of personal property, personal injury, death, or other ailments or injuries that could cause serious disability; these risks and dangers may also be caused by others that are on the property with me for same or similar purposes. I also understand that such injury or damages may be caused by forces of nature and/or risks or dangers that may arise from foreseeable and unforeseeable events or from the natural and unimproved nature of the property. With such understanding and knowledge, I, on behalf of myself, my family, heirs, executors, administrators, representatives and assigns assume all risks and dangers and all responsibility for any losses and/or damages which result from my use of Fieldstone property and hereby release, waive, and discharge Fieldstone Hunting Preserve, LLC, its officers, members, employees, and agents from any and all claims, actions, or losses for injuries, property damage, death, loss of services or other damages arising out of my use of Fieldstone property as described above whether arising from the negligence of those released hereby or otherwise to the fullest extent permitted by law. I have also been informed and warned and fully understand that under Georgia law, there is no liability for any injury or death of a hunting or fishing participant at least 18 years of age conducted at a location such as Fieldstone if such injury or death results from the inherent risks of such hunting or fishing activity. Inherent risks of hunting and fishing activities include, but shall not be limited to, the potential of you to act in a negligent manner that may contribute to your injury or death and the potential of another participant to act in a negligent manner that may contribute to your injury or death. I knowingly and freely assume all such risks of participating in these activities. In further consideration of my use of the Fieldstone property, I hereby give Fieldstone consent to record, video, and/or photograph me and use my image and/or voice for the promotion of Fieldstone or related companies through use in internal company communications or public promotions and advertisements. I also understand that any minor under my care that may accompany me to Fieldstone may also be photographed and/or videoed and give my consent for the use such images in the same manner.
